IMPLEMENNTASI KONDISI KHUSUS DAERAH DAN ASPIRASI MASYARAKAT DALAM PERATURAN DAERAH SEBAGAI WUJUD NEGARA HUKUM DEMOKRATIS

Abstrak

The implementation of local government is directed to accelerate the realization of community welfare through improving services, empowerment, and community participation, as well as increasing regional competitiveness by paying attention to the principles of democracy, equity, justice, and the peculiarities or special conditions of a region that are in accordance with the aspirations of the community into the Unitary State system of the Republic of Indonesia based on democratic law. The purpose of the research is to analyze laws and regulations in terms of the implementation of special conditions and community involvement in the process of forming democratic regional regulations The type of research used is normative legal research. The results of the study show that the formulation of the Regional Regulation in order to realize a democratic legal state has not entirely contained material on the content of special regional conditions and community aspirations in accordance with the needs of the community as an integral part of the national system of laws and regulations based on the Constitution of the Republic of Indonesia of 1945 and Law Number 12 of 2011 concerning the Establishment of Laws and Regulations Number 23 of 2014 concerning Regional Government.

ABSTRAK

Penyelenggaraan pemerintahan daerah diarahkan untuk mempercepat terwujudnya kesejahteraan masyarakat melalui peningkatan pelayanan, pemberdayaan, dan peran serta masyarakat, serta peningkatan daya saing daerah dengan memperhatikan prinsip demokrasi, pemerataan, keadilan, dan kekhasan atau kondisi khusus suatu daerah yang sesuai dengan aspirarsi Masyarakat ke dalam sistem Negara Kesatuan Republik Indonesia yang berdasarkan atas hukum yang demokratis. Tujuan Penelitian adalah untuk menganalisis peraturan perundang-undangan dalam hal implentasi kondisi khusus dan keterlibatan Masyarakat pada proses terbentuknya peraturan daerah yang demokratis Jenis penelitian yang digunakan adalah Penulisan hukum normatif (normative legal research). Hasil penelitian menunjukan, bahwa Formulasi pembentukan Perda dalam rangka mewujudkan negara hukum yang demokratis belum seluruhnya memuat materi muatan kondisi khusus daerah dan aspirasi masyarakat sesuai dengan kebutuhan masyarakat sebagai bagian integral dari sistem peraturan perundang-undangan nasional berdasarkan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 dan Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-Undangan serta Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah.
