PENEGAKAN NORMA HUKUM ADAT DAN PENGELOLAAN SUMBER DAYA AIR DALAM KERANGKA HUKUM INDONESIA

Abstrak

The enforcement of customary law norms and the management of water resources play a central role in the legal context of Indonesia, particularly in preserving the sustainability and diversity of ecosystems. This research aims to examine the implementation and effectiveness of enforcing customary law norms in the management of water resources, integrating them into the national legal framework of Indonesia.

In Indonesian society, customary law has deep roots and often serves as the foundation for the management of natural resources, including water. Despite recognition of customary law in certain regulations, its implementation is often suboptimal. This study involves an in-depth analysis of the legal aspects of enforcing customary law related to the management of water resources.

The management of water resources in Indonesia is governed by various laws and government regulations. However, the integration of customary law norms into this legal framework remains a subject of debate and a distinct challenge. This research explores the constraints and opportunities faced in strengthening the enforcement of customary law in the context of water resource management.

The results of this research are expected to provide insights into the effectiveness of enforcing customary law norms in the management of water resources in Indonesia. The implications of these findings can support policy improvements, regulations, and practical implementations to enhance the protection of water resources, preserve local wisdom, and sustainably maintain ecosystems as a whole. Thus, this research holds significant relevance for the development of laws and policies related to water resources in Indonesia.

ABSTRAK

Penegakan norma hukum adat dan pengelolaan sumber daya air memiliki peran sentral dalam konteks hukum Indonesia, khususnya dalam menjaga keberlanjutan dan keberagaman ekosistem. Penelitian ini bertujuan untuk mengkaji implementasi dan efektivitas penegakan norma hukum adat dalam pengelolaan sumber daya air, dengan mengintegrasikannya ke dalam kerangka hukum nasional Indonesia.

Dalam masyarakat Indonesia, hukum adat memiliki akar kuat dan seringkali menjadi landasan bagi pengelolaan sumber daya alam, termasuk air. Meskipun terdapat pengakuan terhadap hukum adat dalam beberapa regulasi, implementasinya seringkali belum maksimal. Penelitian ini melibatkan analisis mendalam terhadap aspek legalitas penegakan hukum adat terkait pengelolaan sumber daya air.

Pengelolaan sumber daya air di Indonesia diatur oleh berbagai undang-undang dan peraturan pemerintah. Namun, integrasi norma hukum adat dalam kerangka hukum ini masih menjadi perdebatan dan tantangan tersendiri. Penelitian ini mengeksplorasi kendala dan peluang yang dihadapi dalam memperkuat penegakan hukum adat dalam konteks pengelolaan sumber daya air.

Hasil penelitian ini diharapkan dapat memberikan wawasan tentang efektivitas penegakan norma hukum adat dalam pengelolaan sumber daya air di Indonesia. Implikasi temuan penelitian ini dapat mendukung perbaikan kebijakan, peraturan, dan implementasi praktis untuk meningkatkan perlindungan terhadap sumber daya air, mempertahankan kearifan lokal, dan menjaga keberlanjutan ekosistem secara holistik. Dengan demikian, penelitian ini memiliki relevansi signifikan untuk pengembangan hukum dan kebijakan sumber daya air di Indonesia.
