ANALISIS YURIDIS PERJANJIAN KARYA PENGUSAHAAN PERTAMBANGAN BATUBARA (PKP2B) MANTIMIN COAL MINING (MCM) DI PEGUNUNGAN MERATUS PROVINSI KALIMANTAN SELATAN

Abstract

Abstarct :  One of the important coal value chains to be highlighted is the upstream sector, namely in the aspect of licensing and supervision that is not strict by the State administrators. such as the case of the Decree (SK) of the Minister of Energy and Mineral Resources (ESDM) Number 44.K / Djb / 2017 Regarding the Adjustment Phase of the PKP2B Mantimin Coal Mining (MCM) activity into the stage of production operations based on overlaying maps of forest areas and based on Minister of Forestry Decree No. 435/2009, it turns out that the coal mining concession of PT. The MCM partly overlaps with the Protected Forest area. Mining activities in forest areas may not be carried out in conservation forest areas and protected forests.

Abstrak : Salah satu rantai nilai batubara yang penting untuk disorot adalah sektor hulu, yaitu pada aspek perizinan dan pengawasan yang tidak ketat oleh penyelenggara Negara. seperti kasus Surat Keputusan (SK) Menteri Energi Sumber Daya Mineral (ESDM) Bernomor 44.K/Djb/2017 Tentang Penyesuaian Tahap Kegiatan PKP2B Mantimin Coal Mining (MCM) menjadi tahap kegiatan operasi produksi berdasarkan overlay peta kawasan hutan dan berdasarkan SK Menhut No. 435/2009, ternyata konsesi pertambangan batubara PT. MCM tersebut sebagian bertumpang tindih dengan kawasan Hutan Lindung. aktivitas pertambangan di kawasan hutan tidak boleh dilakukan di kawasan hutan konservasi dan hutan lindung.
