Abstract

One of the Bank's superior programs as a collector of public funds is the credit distribution program which is authorized to provide facilities to make it easier for the public to carry out their needs and provide excellent service quickly, precisely and safely to customers. ABSTRAK

Salah satu program unggulan Bank sebagai penghimpun dana masyarakat yaitu program peminjaman kredit yang berwenang memberikan fasilitas memudahkan orang untuk menjalankan kebutuhannya dan memberikan pelayanan prima secara cepat, akurat dan aman kepada nasabah. Sistem pinjaman kredit sering dikaitkan dengan jaminan pelunasan kredit dari debitur agar pinjaman yang diberikan kreditur mempunyai perlindungan hukum atas pelunasan kredit tersebut, dimana objek jaminan favorit para nasabah yaitu tanah yang dapat dibebani hak tanggungan sesuai ketentuan Undang-Undang Pokok Agraria yang memberikan hak istimewa kepada kreditur. Tidak tertutup kemungkinan dalam hal pemberian kredit oleh Bank, terdapat beberapa persyaratan penjaminan Hak Tanggungan tersebut yang belum terpenuhi. Seringkali tanah yang akan dijaminkan kemungkinan masih dalam proses pensertifikatan atau proses balik nama, maka Notaris/PPAT akan membantu calon debitur untuk meyakinkan Bank dengan mengeluarkan kovernot kepada Bank yang berisi pernyataan Notaris/PPAT bahwa sedang terjadi proses pensertipikatan atau balik nama atas suatu tanah. Namun terdapat resiko hukum yang dihadapi notaris dalam mengeluarkan kovernot seperti gugatan antara debitur dengan Bank yang melibatkan notaris tersebut karena kovernot dianggap bukan merupakan produk hukum akibat Undang-Undang Nomor 2 Tahun 2014 tentang Perubahan atas Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris, tidak ada pasal yang dapat mengatur Notaris berkewajiban mengeluarkan kovernot. Maka kovernot yang diterbitkan notaris terlebih dahulu dilaporkan dan diproses di Majelis Pengawas Daerah serta memberikan keputusan apakah memang bermasalah atau tidak sesuai dengan kewenangannya, tidak harus langsung dibawa ke gugatan peradilan karena selain akan mengganggu kedudukan jabatan notaris yang mengeluarkan kovernot tersebut juga akan berdampak pada alur proses penerbitan Akta Hak Tanggungan tersebut.
